Terms and Conditions of Sale

Romy Dance Please read the following Terms of Use and Sale carefully.

SUBJECT
The present General Terms and Conditions of Sale have as their object the purchase of products carried out remotely via telematic network on the website www.romydance.it /.com , henceforth named as Romy Dance. Every purchase transaction shall be regulated by the provisions of Legislative Decree no. 185/99 and, as far as the protection of confidentiality is concerned, shall be subject to the regulations set forth in Law 675/96.

ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE
The Customer, by electronically sending the confirmation of his purchase order, unconditionally accepts and undertakes to observe in his dealings with, the general terms and conditions of payment transcribed below, declaring that he has read and accepted all the indications provided to him, in accordance with the aforementioned regulations, also noting that Romy Dance does not consider itself bound to different conditions unless previously agreed upon in writing.

Romy Dance considers the contract definitively concluded, except in cases of return or withdrawal, at the moment of delivery of the product to the Carrier.
Prior to this moment, it is essential that the product is available and that payment for it is made by bank transfer in advance or by credit card.
Submitted orders will be delivered within 24/72 hours, except for items that are temporarily unavailable or that need to go into production, for which delivery is assured within 5/6 weeks.
In the event that production problems make it impossible to produce the shoes requested, Romy Dance may decide to cancel your order and refund what you have paid without any surcharge or interest.

MAJOR AGE
By purchasing products from Romy Dance, the customer declares under his own responsibility that he is over 18 years of age.
Orders from minors will not be accepted.

CUSTOMER COMMITMENTS
These Terms of Sale must be reviewed online by Romy Dance customers before confirming their purchase.
Submission of the order confirmation therefore implies full knowledge of the Conditions of Sale, and their total acceptance.
The Customer undertakes and is obliged, once the online purchase procedure has been completed, to print and keep these Conditions of Sale, already viewed and accepted during the purchase procedure carried out, in order to fully comply with the condition set out in Articles 3 and 4 of Legislative Decree No. 185/1999.

PURCHASING MODALITIES
Romy Dance (www.romydance.it/.com) is an online sales site for dance shoes, clothing and accessories.
Purchases of the products, available as they are illustrated and described, are made by the Customer at the price indicated, plus transport and insurance costs of Euro 13.00 for Italy and Euro 19.00 for EU countries.
Below is a list of transport and insurance costs for other countries:

The Products are depicted and made visible on the Site in an accurate manner and corresponding to the actual characteristics.
Romy Dance, in any case, cannot guarantee the exact correspondence to reality in relation to the images and colours as they appear on the Customer's monitor.
Before the order is confirmed, the Customer will be shown the unit cost of each product chosen, the total cost in the event of purchasing several products, and the transport costs.
By confirming the order, upon completion of the contract, the customer will receive an e-mail message of acceptance and delivery specifications.

PRICE
The prices of items shown on the site are final consumer prices.
Prices may be subject to change due to promotions.
The price valid for the purpose of the contract is the price visible at the time the order is placed.

USEFUL ADVICE
Please check that you have entered your data correctly: it is important that the given address can be easily found by the courier; we also suggest a place of work of your own or of an acquaintance.

Please make sure that you have entered your telephone number and e-mail address correctly: if there are any problems with the processing or delivery of your order, it is important that we can contact you so that we can agree on any changes.

Romy Dance guarantees maximum protection of confidential information and sensitive data (see our page "Privacy Policy“).

PAYMENTS
Payment for the purchased products and the relevant shipping costs shall be made by the Customer upon submission of the order confirmation, by means of:

• the use of one of the credit cards available and indicated online
• bank transfer

Payments accepted:

Pay securely with your PayPal account or credit/postpay card.
PayPal secures your purchases with the most widely used payment system on the internet. Please note that your financial information (card number, expiry date, etc.) will be automatically managed by PayPal's Secure Server, without Romy Dance or third parties having any access to it.

• Bank Transfer:

To be made before the goods are dispatched. Notification of payment must be sent by e-mail to direzione@romydance.com.

SHIPPING COSTS
These are those automatically calculated by the site.

The shipping cost of Euro 13.00 for more than one pair is only valid in the case of a final purchase of all shoes ordered. Otherwise, if shoes are returned, the true shipping costs incurred by our company will be reversed, namely:

• Two pairs Euro 19.00
• Three pairs Euro 25.00
• 4 pairs Euro 30.00
• 5 pairs Euro 36.00

In addition, if the shoes are not returned perfect and in the original packaging, Euro 12.00 will be charged as packaging costs.

ORDER PROCESSING TIMES
Orders are processed after Romy Dance has checked the accuracy of the Personal Data and contact details provided by the Customer.
Romy Dance has in stock at its Italian or European sites, most of the products on the site, therefore all orders will normally be dispatched on Tuesday or Thursday with delivery varying from 24 hours to 7 days depending on the destination address. As already specified if the product is not available at our warehouse, delivery will take 5/6 weeks.

GOODS CHANGE

1. RESI
   If the customer wishes to change the size of the product he/she has just received, he/she must notify Customer Services (no later than 14 days after receipt of the goods) by sending an e-mail to direzione@romydance.com.
   After due arrangements have been made, the Customer shall return the product to Romy Dance at his own expense.
   Romy Dance, upon receipt of the product (in its original packaging) will check its integrity and will, at its own expense, ship the product back to the Customer in the new size requested.
   It is understood that the possibility of size/product change applies only once per order and is not applicable to articles ordered by the customer and put into production especially for him.
   All items ordered in the OUTLET area are on sale and as such not subject to exchange, exchange or return.
2. RIGHT OF WITHDRAWAL
   Pursuant to and within the limits of Legislative Decree 185 of 22/05/1999, the Customer has the right to withdraw from the purchase, if not satisfied, by sending, no later than 14 working days from receipt of the goods, an email to direzione@romydance.com.
   The modalities and timing of the return are the same as in the previous point.
   The Decree also provides that an essential condition for availing oneself of the Right of Withdrawal is that the goods be returned undamaged and in their original packaging, and that the cost of shipping costs be borne by the Customer.
   Pursuant to Legislative Decree 185/99, it is hereby specified that the right of withdrawal is exclusively reserved to Customers who can be defined as "consumers", i.e. natural persons who purchase products for their own use and act for purposes that are not related to their professional activity, with the exclusion therefore of traders and retailers or purchases to A.S.A. or sports associations in general.
3. REFUNDS
   Should the Customer, for whatever reason, wish to return the goods, he/she shall be entitled to a refund of the price paid for the product purchased, under the terms and conditions of the Right of Withdrawal.
   In the event of a refund request, for return of the purchased product, the commissions retained by Pay Pal will also be deducted, as per the regulations in force worldwide as of 06 March 2020.
   Shipping charges shall be borne by the Customer.
   The refund will be made in full, excluding shipping costs, within 15 days by Bank Transfer to the coordinates indicated by the Customer.
4. LEGISLATION APPLICABLE TO THE CONTRACT
   For all matters not expressly provided for and regulated in these conditions of sale, the applicable Italian law shall apply.
5. COMPLAINTS AND GUARANTEES
   Products purchased on www.romydance.it/.com
   are subject to the regulations, insofar as applicable, set forth in Legislative Decree no. 24 of 2.2.2002 (G.U. no. 57, 8.3.2002) on contracts of sale and guarantees concerning consumer goods and, for anything not contemplated therein, to the specific provisions set forth in the Civil Code. This guarantee shall apply to products that present conformity defects and/or malfunctions that could not be detected at the time of purchase, provided that the product itself is used correctly and with due diligence, i.e. in compliance with its intended purpose. On the other hand, the aforementioned guarantee shall not apply in the event of negligence or carelessness in the use and maintenance of the product. The guarantee is personal and shall therefore only apply to the original purchaser, being reserved for direct customers and not for traders, retailers, etc. Any defect in the products must be reported in writing by the customer within the legal deadline when returning the defective product, which must be agreed upon in advance with Romy Dance. All returned products will be tested and will be returned at the customer's expense if found to be in normal working order. The request will only be processed if the returned package contains a detailed description of the defect found. PRIVACY
Information for those interested in purchasing Romy Dance products:
Romy Dance, as "Owner" of the data processing in the person responsible and in charge, Michele Granatiero, guarantees the utmost confidentiality of the Customer's personal data and full compliance with the obligations provided for by Law no. 675/96 and Legislative Decree no. 171/98.
Pursuant to Art. 10 of Law no. 675/96, containing provisions for the "protection of persons and other subjects with regard to the processing of personal data", it is hereby notified that the Customer's personal data will also be processed using computerised systems and with the help of third parties connected to the company organisation, exclusively for purposes related to the execution of the contract.

Purposes related to the execution of the contract include, in particular, all functions connected with and instrumental to the execution of the purchase order, such as the management of the computer system, payment control, shipment management and complaint management.

With reference to the data provided, the Customer may exercise his/her rights under Art. 13 L. 675/96 (access, correction, integration, cancellation, opposition, etc.) by contacting the "Data Controller" or the "Data Processors". By filling in the "Digital Order Form", the Customer declares that he/she has read this information notice and gives his/her consent to the communication of his/her personal data and to the processing thereof, for the purposes and by the persons indicated in the information notice itself, being aware that in the absence of consent and in the case of ascertained mendacity of the information communicated, the order may not be carried out.

Romy Dance (owner of www.romydance.it/.com) guarantees maximum protection of confidential information and sensitive data; your personal data will not be sent to any third party without your prior consent (see our page "Privacy Policy“).
